Summary of Issues.'''

Human rights is the search for dignity. a people who live in poverty have no experience of dignity. Poverty is therefore a violation of human Tights.

there are frameworks in the forum of UN instruments and various regional and local chapters which bind governments to steer towards the realization of human dignity. activists need not only remind governments on this obligation but should go the extra mile to demand governments to respect their obligation towards a realization of human dignity for their citizen and the world community as a whole.

Not only governments violate the rights of citizens . in developing countries multinational corporations who are more powerful than governments often manipulate governments to pass policies which violates the rights of citizens.

'''recommendations:'''

We need a world where everyone is economically pro-active, a world where everyone is socially inclusive and a world of unity and cultural diversity.
Summary of Issues

Human Rights charter adapted by UN in 1948 mainly to defend promote and present human rights. Human beings are born free, their rights must be protected and respected including property, life, liberty, security. Also protection against torture and other crimes

Declaration on Human rights stipulates emphasis on collective responsibility e.g. community rights attract different interpretations related to culture and religion

God is not mentioned but the unity and dignity is unique enables humans to live in unity and dignity. Negative impulses have affected human rights e.g Jihads, Genocide e.g. in Rwanda and terrorism e.g World Trade Centre

Humans have used God as an instrument of manipulation, extortion and exploration at demonstrated where preconceived ideas relegates one to a certain class in society.

Justice without love in Christianity is inadequate. Christianity should be above culture. Love is most important for humanity. Without Love human rights efforts will not create meaning to life.

Human rights efforts should create environment of inclusively for humanity to encompass even the weak in the society.

Culture without love cannot succeed in bettering humans instead of faith and religion uniting humanity, it is causing divisions. Religion can help human rights through love leading to God.

Emergence of liberalization of economy, then freedom of religion leading to too many denominations has led to growth of fundamentalism and intolerance to diversity. Such is anti-human rights and creates animosity

Some cultures are anti-human rights e.g. female circumcision, exploitation of women in society to provide nourishment to the family but are not part of decision making. Here, culture undermines human rights.

Religion should used positively, not to be an impediment to human rights.

John Ochole Peasant from the Yale community

Summary of Issuess covered
Case presented to court by one of the peasant from the yale community crying out for justice.

John Ochele a peasant from the Yale community who had a very big farm where he was growing food cropps, rearing animals and bees and fishing was very happy before 2003 when the Dominion firms(USA) came in and destroyed all his farm and homestead.

The land on which John Ochele was farming was inherited from his father 35 years ago and this is where all his ancestors lived and werre buried.

In 2003,he was told by his area chief that some government investors were going to do some investments on hiss land, after few months, the Dominion Firm came and suryeved his land,in three days, tractors and bulldozers slashed all his plants and fenced him out of his fishing area.ON seeing this,he consulted his area member of Parliament who asked him to leave this area and find another for settlement which he didnot do because he had no where to go.

After a short while, the company created a dam for electricity generationn.THis dam created a backflow that submerged his garicultural crops and houses

Righ now he is not able to carry out any activity because his land has been submerged. Before the company took over, during the rainy season. There would be occasional floods and his homestead would not be affected but now the floods are permanent right from his homestead-

He still holds the view that this land belongs to him becuase there was no ennvirnomental impact assessment and therefore called upon court to intervene to get back his land tha has been submerged.

Recommendations from the activity
Despite the multii sectoral nature of the swamp,NEMA does not appear to have used its power under section 60 of ENCA to rquire written comments on the EIA by such lead agencies like the fisheries department,Kenya WIldlife services, water and migration department or the department of Agriculture
Therefore the project should be pending comments from above stakeholder
