John Ochele a peasant from the Yale community who had a very big farm where he was growing food cropps,rearing animals and bees and fishing was very happy before 2003 when the Dominion firms(USA) came in and destroyed all his farm and homestead.&lt;br /&gt;

The land on which John Ochele was farming was inherited from his father 35 years ago and this is where  all his ancestors lived and werre buried.&lt;br /&gt;

In 2003,he was told by his area chief that some government investors were going to do some investments on hiss land,after few months,the Dominion Firm came and suryeved his land,in three days,tractors and bulldozers slashed all his plants  and fenced him out of his fishing area.ON seeing this,he consulted   his area member of Parliament who asked him to leave this area and find another for settlement which he did not do because he had no where  to go.&lt;br /&gt;
&lt;br /&gt;
After a short while,the company created a dam for electricity generation. This dam created a back-flow that submerged his agricultural crops and houses &lt;br /&gt;
&lt;br /&gt;
Right now he is not able to carry out any activity because his land has been submerged.Before the company took over,during the  rainy season.There would be occasional floods and his homestead would  not be affected but now the floods are permanent right from his homestead-&lt;br /&gt;
&lt;br /&gt;
He still holds the view that this land belongs to him becuase there was no ennvironmental impact assessment and therefore called upon court to intervene to get back his land tha has been submerged.&lt;br /&gt;

Despite the multi sectoral nature of the swamp,NEMA does not appear to have used its power under section 60 of ENCA to require written comments on the EIA by such  lead agencies like the fisheries department,Kenya Wildlife services,water and migration department or the department of Agriculture &lt;br /&gt;

CIEL co-organized this two-day workshop with a wide range of organizations, including among others, the Council of Canadians Blue Planet Project; Focus on the Global South; Friends of the Earth International; the Global Forest Coalition; Oilwatch Africa; Via Campesina; and the World Forum of Fishworkers and Fish Harvesters&lt;br /&gt;
&lt;br /&gt;
This event involved a diverse array of civil society actors, especially from Africa, to discuss the impacts and underlying causes of the commodification of various natural resources. The workshop allowed the speakers and participants to analyze different regional concerns; and to exchange ideas about effective campaign solutions, strategies and tools. The workshop focused on the following natural resources: land/seeds; fisheries; forests; biodiversity; energy; minerals; and water. &lt;br /&gt;
&lt;br /&gt;
The first day of the workshop involved exchanging ideas about effective campaign solutions, strategies and tools to maintaining and restoring community/indigenous management of natural resources and related knowledge. Speakers discussed successful community management projects and campaigns, particularly how these projects have been protected, initiated, promoted, and developed, as well as the key difficulties. &lt;br /&gt;
&lt;br /&gt;
In addition, the first day of the workshop involved an exchange of ideas about the experiences of direct action and nationalization of natural resources (with a particular focus on Bolivian and the Venezuelan examples) and examined the related impacts on communities' access and the sustainable use of natural resources. &lt;br /&gt;
&lt;br /&gt;
The second day of the workshop focused on exchanging ideas about effective campaign solutions, strategies and tools involved in making, changing and using the law. Particular attention was paid to how communities can use, change and make laws to help regain access to or prevent the destruction of their natural resources and environment. In addition, the workshop looked at how to use national courts to change corporate practice and seek redress. The focus of this session was on oil, mining, water, and forests.&lt;br /&gt;
&lt;br /&gt;
The second day also focused on the potential role of new technologies and market mechanisms. More specifically, this part of the workshop focused on whether the emerging new technologies are likely to help or hinder people's access to natural resources, and how the market mechanisms impact local communities and their access to natural resources and a clean environment. The focus in this session was on nanotechnology and new markets in biofuels, carbon and environmental services.&lt;br /&gt;
&lt;br /&gt;
The workshop was followed by a strategy meeting of the organizers to discuss follow-up, including building a network and creating advocacy tools.&lt;br /&gt;

The political process that had to emerge after the elections has not brought what was promised. Instead of stabilising Iraq it was all bad, negative.&lt;br /&gt;
The process was selective. Some parties, some groups, some tribes, some .. gained political power while others were excluded. This pushed the violence between religions, groups, etc. The main goal was occupation, not rebuilding Iraq. The aim has always been to redesign Iraq to suit US foreign policy. &lt;br /&gt;
From the onset, the occupation took a dangerous route: p.e. Focussing on a new constitution emphasising the differences between religions. Not only acknowledging that there are differences, but taking the differences as the defining starting point for a constitution. Using ethnic differences.&lt;br /&gt;
The new gov uses the word reconciliation to push their agenda in stead of creating space for respect for differences. &lt;br /&gt;
Linked with the regional sensitivities (religion vs religion, but also country vs country). &lt;br /&gt;
The use of violence became the modus operandi for the Iraqi government, singularly focussing on security now, while putting human rights, and other rights in second. &lt;br /&gt;
Reality is that people were driven into the hands of the militia, for their safety and livelihood. The history of Al-Qaeda in Iraq starts after the invasion, not before.&lt;br /&gt;
Iraqis make a distinction between terrorists and resisters. For a long time, resisters were not aligned along sectarian lines. Now, this is more and more the case. Neighbours are, for their safety blocking roads for their neighbours now. More out of fear than out of hate. Iraqis do not believe military force can solve anything. Everybody feels that. But all Iraqis are forced to take sides on all violent issues. &lt;br /&gt;
All promised about freedom, human rights and democracy are broken. The only solution to this conflict is the end of the war. They realise how important it is to have a large and thriving CS. But now, how can they organise themselves. They are pushed in a corner and the violence of the US, the army and police, the militia and gangs, the criminal orgs, but still they try to manage. A lot of civil society reps have left the country, some of them were killed in Iraq. The exiles still try to work from their Diaspora with and for Iraqis. &lt;br /&gt;
Their biggest fear is to remain isolated. Under Saddam they were, and during the war they were. And now they are still. &lt;br /&gt;
Foreign CS�s also left when the kidnappings started to rampage. One of the remaining things we �like UPP –�to remain in contact and build common projects with Iraqi SC�s. PSA is used when the production possibilities for oil are uncertain. Only giant oil companies like Shell can take these risk, but in return, they get most of the benefits. In Iraq, getting the oil is not difficult. PSAs should therefore not apply to Iraq. And Iraq under occupation should not be pushed into 40 year running programmes of which the majority of benefit goes to western privately owned companies. &lt;br /&gt;
The Hydro Carbon Law (for Iraq) was drafted by a neo-con think tank,. It was after that reviewed by the UK gov, the IMF and several other govs. But no Iraqi saw it before it was passed. It created the possibilities for PSAs. &lt;br /&gt;
